A gun out of sight shouldn't change anything.

If Smith's gun was in a compartment, this changes nothing. Where was the forced entry to Hayes home or vehicle in this situation? Hayes shot Smith while Hayes was standing outside of his vehicle. Smith was retreating back to his vehicle. It doesn't matter if Smith intentions were to get his weapon. It wasn't on his person when was shot & killed. Hayes shot Smith in the back.

according to Fun Bunch they knew about it the night of. It may not have been concealed, and even if it was, there is a chance Hayes felt threatened for his life.

If there is NO GUN, there is no fricking way his LIFE can be THREATENED. None, zero, zilch. We wouldnt even be talking now and all of his charges would stand.

To say it doesnt matter makes no sense. It's one of the keys to the whole malay.

Based on what has been reported, Smith never pulled his gun. He likely said "I have a gun", but he never pulled it. Hayes opened fire, he should go to jail for quite some time.

none of this matters if Smith was reaching for a gun after announcing to Hayes he had one on him. At that point Hayes' life is threatened.

nothing has come out yet about where they found the gun, or why Smith's back was turned when he was shot. He could have been in the process of pulling his gun from wherever he had it. The people in his car should know.

To simply say "Hayes should go to jail for a long time" without knowing those facts is irresponsible

Good luck with that story since no gun was visible on Smith's car or found on his person.

Pure speculation here but if a pissed off 6'3 280 pound man was getting aggressive with you you wouldn't fell threatened? Again assuming Smith was getting aggressive. He may have said bitch I'll kill you. Good discussion but until all the facts come out we're all speculating.

the news hasn't reported anything one way or another on where the gun was found. Just that it was loaded and wasn't used.

NOPD said no visible gun found in Smith's vehicle. LE was adamant that news reporting something is all you need to believe it and call it a fact, but he seems to have backtracked from that when the news reported something that hurts his argument.

I see your point, but with the way they found Smith and where he was shot(in the back), this is unlikely

Was Smith not shot standing next to or partially in his vehicle from the pictures posted on Nola.com? If Smith isn't shot near the driver door of his vehicle then how does his wife receive a stray bullet to the leg. You are grasping at straws dude. Maybe you need a break.

If Smith's gun within arms reach or in his possession, there would have been no need to obtain a warrant to search for it. It would have been evidence as part of the crime scene. Derp.

Thats a big if and an even bigger reach. There is literally nothing out there that suggests Smith brandished a gun. If the gun were visible, the police would have had it Sunday and you know it.

I think you may have meant to say, his charges would NOT stand. Either way, before you knew Smith had a gun, you were knighting your arse of for Hayes anyway, so I'm not sure what point you think you are making here.

Hayes obviously had two guns that night, one he used to shoot a man in the back in front of his wife and friends. Does that make you more likely to think he is guilty? It doesn't seem so.
