Maybe he means hemming and hawing.

quote:

hemming and hawing

speaking hesitantly and inarticulately, with numerous pauses and interjections.

Still doesn't make sense.

Hemming is when you put ur hands on somebody in a restraining position. Like shaking a female by the shoulders.

Its not my opinion dude, look up the definition of self defense. You cant claim self defense if there is no immediate or imminent danger.

There is a difference between self defense, and stand your ground.

Well i guess we certainly disagree on what immediate or imminent danger is.

I mean if someone has their back to me and keeps reaching for the gun I will keep shooting.

That may have happened as well. I guess I would be burned at the stake for it but better than getting shot

like I said already, there is no law that says you cant shoot someone in the back in self defense. thats stupid.

its all about how believable you are and how the facts are laid out. similar to what happened in the case those guys posted earlier. the shooter lied about all kinds of shite and the jury dismissed his claims of self defense because he was clearly dishonest.

if smith threatened with a gun and made a move to obtain that gun and hayes story is consistent with evidence and witness testimony, then there is a good chance he will walk.

I hope the courts get this right in the end. But Saints fans look stupid to think Will Smith was some angel.

Same people loved Sharper and said "no way is this true"

I don't fall for idolizing athletes anymore. Too many of them are loose cannons ready to go off.

Yeah but there is one huge fact you are overlooking with this repetitive stance you keep pushing. If Hayes got out of his vehicle with his gun already on his person then Smith had every right to go for his gun being that SMITH would have been in imminent danger.

did smith know he had a gun? I have already said that if hayes got out brandishing his gun or pointing his gun at smith then he was done.

Do your own googling, I'm not here to provide you with anything other than my own experience/opinion. There are legal definitions of those words, and they are easily found with google, or any other simple search engine. You are more than welcome to keep arguing, but shooting someone in the back- is NOT now, nor has it ever been, a case for self defense.

You are wrong. Sorry, but you are factually wrong in both theory and in practice. And not a single lawyer would agree with you

I mean you are so wrong, you come off as a fool.

So someone comes up to you with a gun, threatening to kill you. They drop there gun and turn around to pick it up, and POW, you finally had time to draw your gun and shoot them in the back.

Not self defense I guess for lsufan31

"frick you, I have a gun too." If that witness from the video heard that, I'm sure Smith did too. For Hayes to have the drop on Smith, he had to have had his gun on his person with both patries being out of their vehicles. This isn't rocket science dude.
