One scene doesn't make one 3 hour movie better than another 3 hour movie. Whether you like the build-up that makes no sense without seeing every other marvel film or you like the money shot that means nothing without seeing every other marvel film is really a matter of personal taste.
But you guys are arguing over something irrelevant anyway. This is a superhero movie list, not a superhero mini-series list. Neither belongs.

The list is already over with Kick-arse at 45 and the hot garbage known as Man of Steel at 44. The later shouldn’t even be on the list.

Still, anyone who places Dark Knight at #1 doesn't know what a superhero is. Or what comics are. Great movie. Great crime movie. Still not a superhero movie.

Look, I love a good homage to The Fantastic Four as much as the next comic book reader, but I was only ranking live action.
Brad Bird would be my fist choice for Marvel’s The Fantastic Four.
And because they(Marvel) do superhero science (ie time travel, space exploration) better than other studios (Fox) it will be a MASSIVE franchise if Disney survives that long.
I appreciate collider for including some animated and non traditional superhero films like Unbreakable and Incredibles while avoiding some trash movies like DFOP, Daredevil
But Aquaman over Shazam?!?
