I never got the hate for the public defender. He is given a client that has just confessed to the murder. What plan are you supposed to follow after that?
Did you not see how the only two competent law practitioners in the documentary handled it?

No, no she was not, and no she did not consent.

Almost only counts with horseshoes and hand grenades.
Also, the guy didn't almost kill her, he wasn't even charged with attempted murder, probably because he didn't even attempt to kill her.

I honestly think you are just messing with me now. You watched the show, he was sitting on the couch and she came inside, then sat next to him.

This is true. However, the mom later said in one of the last two episodes that she wanted to go in, but they wouldn't let her. This was said after one of the interrogating detectives said under oath that she had the option to come in but opted not to. So yes she was there but may not have been allowed to go in.
In regards to that, it really comes down to her word against his.

I was thinking about the interview where they pulled him from school and at the end he asked if he could return for 6th period. That's when they charged and arrested him. They didnt show his mom at all and I was thinking how can they interview a minor, especially one that is borderline retarded without guardian consent or a lawyer? Maybe she was there, but she wasn't shown, but I do remember her coming in and talking to him at another time or maybe the producers just edited like it was a separate time. Regardless she did say they wouldn't let her in during the interview.
ETA
I went back and re-watched the end of episode 3 and yeah it was the same interview. They interrogated him for 3 hours and then let his mom in before they arrested him. She should have never allowed that, but I guess she never figured he would confess to rape and murder.

Did they ever explain why the judge would not let them point out how other people could have done it? They could only prove he didn't.

I never heard an explanation. Judge's prerogative, I guess. I was also wondering why the same judge presided over the appeal? wtf?

Yeah, that does seem like a conflict of interest.

State law (seems like a bad one.)

That was the original post-conviction motion for a new trial.
Appeals are panels, almost without exception.

Dead Certainty--New Yorker article
Y'all, the link I posted takes you to a really good article about the show. Goes pretty in depth but not a super long read.

Just finished episode 4. This whole case is one big clusterfrick.

That article beats around the bush for a while, but I do agree with the sentiment. The documentary had a narrative to sell as much as the sheriffs department. Granted, a mans future wasn't hanging in the balance as a result of their documentary and they never swore an oath in court.

So basically they berate the two producers because they never prove who killed her.
If nothing else this documentary shows some of the shitty evidence and tactics that is used against people in trials. For that it is a positive.
