Well we can't rule that out either. Everything in this thread is still speculation at this point. But in my experience I would say that this case is ripe for a grand jury presentation once it's all said and done. Let the community decide to charge or not. It takes the pressure off the DA and sheriff to make that call.

not at all, it does look like he probably gunned it as he was driving by they guy but at that point he's moving pretty fast any way and the guy is coming down the track. He could have gunned it to try to get by the guy. At the most I could see them trying to convict on involuntary manslaughter.

I'll bet it is put before a grand jury. Doing that alleviates the DA from having to make the call. This with a death like this which will have some political pressure on the DA, he gives it to the Grand Jury. If they charge, it's not his fault. If they don't, still not his fault.

A quick experiement for you to do, go find a dirt road somewhere. Build up speed to about 30 mph (which is way slower than they were driving). When safely away from everything slam on your breaks to stop.
Or put a marker down and gradually stop.
Get out of your car and then see how long it took for you to come to a complete stop.
Not as easy as it sounds (or possible) to see the guy in the middle of the track and just "stop" to avoid him.
That's not even considering that stopping on a race track under caution could cause more problems.

He could have been trying to accelerate attempting to miss him. Anyone with a driver's license knows that when you lock up your breaks, you have very little control of a motor vehicle.
I'm coming at this clear eyed. I don't follow Nascar. The only two Nascar drivers I'd be able to pick out of a line up are probably Dale Jr. and Jeff Gordon. All I'm doing is looking at the information that is out there and anyone that thinks Tony Stewart should bear any blame for this in any way is wrong.
