If a driver checks up under yellow, you're not obligated to run them over for the sake of not passing. Hell, if the car in front of you fails to maintain caution speeds, they run the risk of losing the position altogether.
Stewart attempting to go around the suddenly slowing 45 (if that was indeed the case--I'm not saying it was) wouldn't have been illegal if he were trying to avoid contact and if he ceded the position back at the first opportunity.

Only 5 cars passed while Ward was out of his car, and you can't see 3 of the 5's tires. Reach much?
The more I watch the video, the more it looks like Stewart was going around the 45 and Ward was in the way of that.
And Ward looks even dumber now that the initial shock of oh crap that dude died has worn off.
