Very plausible. I mentioned this scenario in a roundabout way earlier today. The girl, for whatever reason, changes her mind at the last moment yet JW might have not stopped at the sudden line drawn in the sand in the heat of the moment.

And that would still be rape.

I still said thats rape..

I guess the more interesting development would be..

Did she tell him to stop beforehand...or during

Both are still rape.

But I wonder if Jameis lawyers uses her "consent" against her. (obviously not being raped...but just twist her words to make her look bad)

Yep... and when you file for that warrant you file it to the DA office i believe. Which means you file it to your superiors. The same superiors that they were supposed to pass the case on to, but failed to do so.

Yeah who knows who may have been in on a cover up due to whatever power broker allegiances or fan loyalties? It may also just be a case of where nobody wanted to tackle this potential behemoth of a situation and just wanted it to go away?

Yep...

But if they have pictures of her injuries in the rape kit, its over.

Well its there job to do that. Regardless of the scenario and situation.

All i know is this is an extremely interesting situation. Not just because its Winston, but because of the actions of the TPD, Detective, and all parties involved.

Yes, it is still rape. Anytime a female says no the sex must end.

Indeed it would be, I made that point earlier too. A guy MUST have more control of himself, knowing when to stop or face the consequences.

Going to be very interesting whether she tells the SA if there was initial consent or not.

Because as Bama Chick pointed out..

quote:

rd to fake the kind of restraint bruises that would happen in a rape. Also, if a woman is forcibly penetrated, she is going to have tearing and damage to her privates, externally and internally

Because if her bruises are not to that extent...that leaves some grey area (for Jameis lawyer)...

Then again. Maybe she just outright tells the SA it was never consent ,etc etc .

And all this talk is again pointless.

Going to be very interesting whats said tomorrow.

Also....It just shows how the cops botched this case when they have a victim with bruises and they dont act upon it. smh.

There's so many scenarios where something along these lines could be the explanation behind so many odd details.

A gray area that really did finish in rape however a rape that's going to be almost impossible for the prosecution.

"It is absolutely untrue," Carroll said. "This is a victim of rape, which occurred on Dec. 7. She identified this guy sometime in January. This whole situation -- think about it, think about it -- if she wanted to ruin this guy, she would have done it a long time ago."

Carroll said the woman returned to FSU for fall semester and was trying to move on from the incident, until Tallahassee police changed the case from open-inactive to open-active status last week and then referred it to the state attorney's office more than 11 months after the alleged crime was initially reported.

"She's not someone with any interest in ruining the football team," Carroll said. "If this victim was interested in notoriety, why would she have not taken any action all this time? Anyone with a brain can see that. It's ludicrous. It only came out when someone from the press got ahold of this. It's really ruined her life. There's no benefit in this to her whatsoever. She's a good girl, and this is a nightmare. She was trying to move on with her life, and there was no benefit to her."

Cant help but feel sad if this is true.

Yes, but it sounds like there is enough to charge him with a felony. If he's even charged, he's fricked.

On Sportscenter, they said the SA's Office and Meggs said they hope to either file charges or not by sometime next week.

Thanksgiving holiday news dump, anyone?

I don't understand that. If they spoke with the accuser today and have the rape kit evidence, why not go ahead and arrest him?

This is the same office that dropped the case for 11 months, you really think they'd decide to be on the ball now?
