Maybe a douche move, but the rivalry is pretty intense and the dude should have known better. It's highly possible that he did so in purpose in which case the firing is justified.

If Gundy wants to fire a guy over a shirt that's being a dick IMO but whatever, his choice.

On the other hand if they had a contract and Gundy broke it over a shirt, then he should be sued for breach of contract. Assuming there was no Tshirt clause in the K

If you live in Oklahoma and you know you're working at Mike Gundy's house - I find it really hard to believe "you accidentally" wore the rival shirt to the jobsite. Dude wanted to incite and be the man (maybe even as a joke) and tell his friends and instead Gundy was the man.

There have been lawsuits from people getting fired from national stores for wearing competitor's gear. It reflects poorly on the company having an employee who doesn't even like their employers products...same with Gundy, he can't have an employee prancing about on his property wearing a OU shirt - it reflects on Gundy.

Employer/Employee at -will relationship is not the same for as contractor especially if there is a written contract btw the 2

Even if he did do it on purpose, if I wear an Alabama t-shirt when I know I'm going to be around a bunch of Auburn fans I expect some shite talking and some ribbing, but I certainly don't expect some douche to freak out and tell me that I offended his wife.

If the guy fulfilled the obligations of his job (sounds like he was the lawn man or something) then I don't see how you can justify his firing. A normal person would have laughed about it. There is nothing whatsoever inherently offensive about a college logo.

Gundy is justified for breach.

Incapacity of a party - Plaintiff has obvious mental limitations.

Mutual Mistake - Gundy believed the guy wasn't a douche.

Misrepresentation - Plaintiff probably misrepresented that he was an Okie fan to induce Gundy to enter into the contract.

Unconscionable - No court in Oklahoma will enforce a contract that requires Gundy to employ an OU t-shirt wearing buffoon.

Thats the kinda shirt Im talking about....fun and somewhat expected to wear or see as a 20 year old in the student section...not something to wear as a 40 year old contracter to mike gundys house...

No. But not every defendant/plaintiff relationship is treated equally. Mike Gundy is a huge public figure in the state. And he's known as the Face of Okie State. He basically represents the university.

It would be like a waiter at Bill Gates house, serving Hors d'oeuvres to distinguished guests wearing a "Microsoft sucks" t-shirt. It reflects poorly on Bill to employ a guy like that.

I don't think you understand the concept of "free". Sure, he's got the right to wear whatever he wants, no one is denying that. But Gundy is free to fire him for that. Really not a hard concept to grasp, well, for most of us.
