Ronald Gasser, 56, had faced up to 40 years in prison. Defense lawyers argued that Gasser fired in self-defense when McKnight walked up to his car following a 5-mile confrontation that began on a bridge spanning the Mississippi River in New Orleans and ended with gunfire in neighboring Jefferson Parish
quote:
Gasser was indicted on a second-degree murder charge. The jury voted 10-2 for the lesser verdict of manslaughter. Gasser did not leave the scene of the shooting, and he was released for a time after being questioned. He is white, and his release after the shooting of the black athlete sparked protests from some who said race was a factor.

30 seems too long IMO... maybe 10 or 20 would have been more appropriate

Louisiana doesn't require unanimous verdicts?

well, that's one more area where Louisiana fails. If you're taking away someone's freedom and the burden is beyond a reasonable doubt, a non-unanimous verdict tells me the state hasn't carried its burden. Regardless of my feelings on this particular case, that is bad judicial policy.

Yeah but if you change the law you are seen as "not tough on crime."
That being said, I don't really feel bad for this guy.

It is better to risk saving a guilty person than to condemn an innocent one.”

maybe, but I having a such policy is a miscarriage of justice. If people feel that means someone isn't tough on crime, that just speaks more to their ignorance IMO. This affects everyone, not just this one frickhead. I'm honestly surprised any state still allows for this, but if one does, it does not surprise me that it's Louisiana.

Nope, just like Oregon.

bullshite dude is a menace to society, it is only a matter of time before he got in another road rage incident and hurt/killed someone. He escalated from physical altercation to pulling a gun out on someone quickly, if he got off on this one for his weakass "self-defense" defense he would be quit the Billy Badass the next time for sure.

He got what he deserved. He brought out the gun to a fist fight

Couldn't agree more. Since two U.S. Supreme Court decisions in the 1970's upholding these non-unanimous verdicts, the court has regularly refused to grant certiorari to hear challenges to the system. If they do, I don't see how they remain in place. The fact that a 1 in 6 people can dissent from a guilty verdict and it still be enforced is an absolute sham.

Does this mean the two dissenters wanted the full charge?
