I just watched the video of Max playing Inspector Seb. I wonder if the DRS infraction was found by the inspectors when inspecting the wing deflection. Kind of a "wait a minute, what's this?"

If its found Merc was out of spec as is already indicated…. However, it isn’t enforced because Max touched a car and “contaminated” it, then yes.
Max touching it wouldn’t change the height/width of the wing or gap.
