Former Tarheel Player Estate sues NCAA, ACC, and UNC

Law suit filed today is 39 pages claims the NCAA, UNC, and the ACC negligent in warning of dangers of CTE. Also claims that he was never warned of the dangers of playing football.

He played in the 1990s. I can't recall any meaningful discussions about the long term health risks that football posed to your brain. The only thing people would moan and groan about was a bum knee and stuff.

So in all his years of playing football he never heard of or saw one guy getting injured ever? I find that far fetched.

Absent intentional misrepresentation on the part of those entitees, I would never side with this filers. Ridiculous.

Noe if they show the NFL held back research, that is another story, but they apparently were not named..........

LaMountain and Noah Hoffman in 2016 were appointed co-personal representatives of Hoffman’s estate by a judge in Florida, where they and Ryan Hoffman lived.

This is absurd. It's equivalent to a 70 year old finding out that he has lung cancer and suing every restaurant with a smoking section that he had been in (not to mention hospitals, schools, etc.). The knowledge and understanding of consequence wasn't available at the time. The earliest head trauma/brain injury studies were '97-'00.

Irrelevant. The CTE aspect wasn't touched on and a multitude of people that played prior to the football industry probably have grounds to sue.

How is it different than something like mesothelioma?

Because asbestos has been known to be deadly since 1906. People don't sue because they have mesothelioma. They sue because they feel they were knowingly or negligently exposed to something that's been well documented for a century.

Because how are you supposed to warn people of something that you don't know exists at that time? I'm sure when he signed his letter to go play there there was a section in the contract that made it clear he was responsible for injuries or long term ailments related to football.

You're not making any sense. Asbestos has been known to be deadly since the dawn of the 20th century. Litigation didn't get serious until the 1980's; 70 some-odd years later when negligence is easy to establish. Mesothelioma is not relevant in your example. The crux is negligence. How can you find the athletic bodies negligent if no person in the entire world knew the correlation between head trauma and long-term brain injury.

I find this as preposterous as smokers suing tobacco companies because nobody ever told them dragging dark smoke into your lungs was bad for you.

I think any litigation related to CTE and the "dangers of football" that may classify as negligence, fraud, misrepresentation, all the available contorts out there is all a bunch of bullshite. If I was a judge, I'd immediately dismiss the case but there are courts out there that LOVE allowing people to be stupid and then possibly successfully sue. Most litigious society in the history of the planet guys, great reputation to have
