Honestly, I like the BCS. I like the controversy. I don't think playoffs are drastically more "fair" or more entertaining. And if LSU had gotten screwed by the BCS, I'd probably be in favor of Barton's efforts.

The problem is the regular season - there is usually not a particularly clear 1 vs. 2. Neither BCS nor any other postseason system will change this.

The NCAA and the BCS schools get tax exempt status from the government as non-profit entities.
Perfectly within the governments purview to examine if those tax breaks are still warranted or to use that as a stick to force college football into doing something

That's just it. It's not Congress' job to change it and they're not going to change it. They're just gonna say that the BCS is a monopoly and dissolve it. This is going to ultimately force the NCAA to adopt a playoff system, which is the ONLY other option. To put it more bluntly, congress is not deciding playoff over BCS.
