This is braindead. It’s about as capitalistic as we can get.
And the comments about it being the only sport blah blah blah are ridiculous too. It’s a business first. A business that is invested in a sport.
As idiotic as I think NASCAR and the France’s are, don’t sign the damn agreement and go start your own league if you don’t like it.
The teams are advocating socialism.

Good luck with that.
If they win then the clown cars will be even more equal and parades based on qualifying spot.
If they lose then expect lots of speeding tickets and other infractions including more inspections from the “random” pick lol.
This lawsuit soils the effort from all those who earned their way over years and even decades. Basically, they want DEI favors - equal outcomes not equal chances.
I am not a fan of Nascar, but this reeks of MJ thinking he can do whatever he wants. I loved him as a player, GOAT. But do not agree with this. No one is stopping him from giving money to those smaller teams. Or leaving the sport. Heck, he has a driver who could win title this year. And his team didn’t exist that long ago.

If you created an NFL team at origin that is now worth billions, and new owners have to buy an existing team to get in the game (a charter so to speak), should the oldest owner have less value than than the new owner? Old bought at $1 and new bought at $100. Both have increasing value gains but oldest one has more value over time.

I would also wager that Larry Mac and the rest of the old-school NASCAR crowd are petrified right now, maybe as much over the specter of "outsiders coming in and screwing things up" as they are of retribution from the France family. There is a clannish air around NASCAR, always has been.
Who knows how this will turn out?
But the fact that NASCAR is a private organization is absolutely meaningless here. Again, the fact that a court of law disrupted "the way things have always been" for another private, voluntary organization, the NCAA, screams volumes here.
NASCAR is facing an opponent who can pay for this out of pocket change, and is facing a lawyer who beat the NFL and the NCAA.
I would imagine there's some sweating going on in Daytona Beach. And the old-school crowd better hope Lesa France Kennedy is calling the shots on defending this, because she's the only one of Bill Jr.'s kids who has the sense of a gnat and Uncle Jim is an aged doofus.

Prediction: Rather than open the entire financial history of the organization to discovery, which I guarantee you will be of a proctological nature given Kessler's track record, NASCAR blinks and a compromise is reached that gives the teams more of the pie and gives Front Row and 23XI charters.
Plus I will guarantee you that Denny Hamlin is stirring this cauldron just as hard as Michael Jordan is.

There is zero doubt in my mind they will settle but that might take a few years and make penalties against these teams interesting.
One thing Nascar does not want to do is open their books. But there will be some punches thrown each way first. And if any TV agreements come due while litigating they may have pause to invest/extend until settled.
And you never know, the 3rd gen of France family may just cash out and sell the whole thing to MJ or someone else. I know its a declining sport based on how its being run and the clown car. They need less rules and more innovation. Cars are too closely spec’d now and it makes racing boring other than manufactured plate races.
