Selling a deceased family members vehicle

So my dad recently passed away, he was divorced and single. My brother don't want his truck and wanna sell it. Is this going to be a hard process? His truck is paid for, title in hand, I have the truck at my house and insurance is still current. How much of a hassle is this going to be for me? Thanks in advance.

I think all you'll need his is death certificate and a succession letter to bring to the notary when you sell it so the title can be property transferred.

Call the DMV or go down there and find out what it takes. You may have to get a clear title from them before you can sell it.

If it's just you and your brother, and the estate is not too large, I would suggest looking in to an Affidavit of Heirship. All you need is a disinterested third party that knows your dad's marital and family history. They're very easy to draft and really serve the same purpose as a probate, assuming your father didn't have a bunch of specific bequests to different people.

First off, sorry for your loss.
Did he have a will? If so, who did he leave the truck to? That person can petition to be placed in possession of it, and sell it.
If there is an executor named in the will, that executor can probably sell the truck in his role as executor, and then the estate gets cash, which it then distributes according to the will or the intestate laws of your state, if no will.

This is in Louisiana, there was no will this was unexpected. Its just me and my brother that would recieve any of his belongings. The truck is paid off, I have the title in my hand. A little monkey to throw in there is that the title is in his name and his business name also. Seems like a huge pain in the arse to take care of all these things.
