It means that you timely submitted all documentation needed for the credit claim and that the court eventually determines your type of vehicle, purchased when you did, indeed qualifies.

The court is involved because the credits were denied. If the court decides that the credits were denied improperly, you will be paid your credit.

This was a joke. Louisiana politics. There never ever should have been a tax credit for this bullshite. The state screwed up big time and lost an ungodly amount of money from it. Customers didn't pay more for flex fuel equipped vehicles, in return should have never gotten money back for it. PS I got my $3,000 but it still was a joke.

Following up on this, the la dnr just says "we have reviewed your tax return and determined that the requested alternative fuel tax credit does not qualify per LA Administrative code 61.I.1913."

Talked to a buddy who's a tax atty and trying to sort out if it's retro-active amendment or not, opinions on that aspect?

Wondering if there's been any changes regarding FF Credit. I've heard of someone getting the denial letter and responding to LDR with a copy of the 1st Circuit Court of Appeals ruling from Dec 28, 2015. Approximately 90 days later, a 3,000 check appeared.

Update - they denied my credit in May, I appealed to LBTA and submitted my documentation again and included a court case as supporting documents.

Heard back from the LDR attorney and they have lost the court case and been instructed to pay my claim.

As a Louisiana taxpayer, I am sorry that our government caused you the inconvenience of delaying your claim. But the outcome is exactly as I suggested back in 2015. The same thing is going to happen with respect to the credit for installation of solar energy systems.

Update - Received another denial letter this weekend similar to the first one. Apparently it was accidentally sent out by the computer system.

Now today they are offering to settle my credit for approximately half the amount I technically qualify for.

My accountant says we are in bizarro land right now since normally it is the tax paper who is trying to settle for less not the state with you.

Considering now if I want to accept half and be done or try to get the full amount.

can only claim it on 2012 and half year vehicles for 2013 that qualify. They tightened up the qualifying stuff in 2013, effective Jan 1 2014 tax year, but it wasn't retroactive.

Google the la tax law listed at top of thread and read up if your vehicle qualifies,

i have even a flex fuel E85 2012 Silverado, when did they change the alternate fuel storage regulations? reading the statute now it seems it wouldn't qualify?

The law change is not retroactive, you can still amend your 12 tax return to claim it through the end of the year. I amended my 2011 return in dec last year and got this ball rolling thanks to this timely thread and a newspaper article I read at Christmas.

I think i'd tell them hell no. You either qualify or you don't.

I'm awaiting a check. Last phone call to LDR the guy who has my file stated my amended return was in review and then needed a copy of the registration that included the VIN to prove that the 8th number was a 0....which identifies it as a qualifying vehicle for 2011. Still have fingers crossed.

Bump for an update

LDR beat me down to 1,500 also. They claimed that 1,500 is what the credit is now and since it was an amended return and not an originally filed return that is what the credit would be (and they'd send the check immediately... or i could take it up with the board of tax appeals). I caved.....received the check plus interest yesterday.

First I have heard of this, just did some googling and found this

"The relevant version of the credit statute was the version in effect in 2011 when the taxpayers purchased the vehicle, not the 2013 amended version which subsequently disallowed the credit for FFVs. The court held that until taxable years beginning January 1, 2014, purchases of FFVs such as the one purchased by the taxpayers were eligible for the alternative fuel tax credit."

So does this mean a Flex Fuel truck purchased in May of 2013 would be eligible for an amended return for the 2013 tax year?

That seems to be the case. Might want to give your CPA a call if you purchased a qualifying vehicle in 2013

I have not responded yet but the statutory language has to be retroactive. That's the crux of the case which they repeatedly lost and which has now forced the ldr to start paying out these claims.
