How the hell can 140% of GameStop's stock be shorted?

I think the DOJ is looking at the wrong end of the wolf.

I was called a terrible attorney for suggesting there were laws in play for possible prosecutions

Exactly.

No retail trader is big enough to manipulate the market. The Redditors had to hope tens of thousands of unconnected people did the same thing.

You would also have to prove that an individual investor was trying to cause the market to behave a certain way as opposed to taking advantage of a widely publicized situation.

You mean. Like a guy posting dialy about everyone buying together and causing a short squeeze on a social media sites? Cause yeah.....they're probably not done breaking it off in wsb arse after that stunt

The question is prosecute who? How do you have 140% of GameStop shares shorted? Are there phantom shares? Or counterfeit shares floating around? A trick? A gimmick?

I ask this out of law naivety not as a gotcha.

What makes this different than a hedge fund manager going on CNBC and talking about how a stock is primed for a squeeze, or how they're short because the company is going to fail?

The fact that more people aren't outraged about this and coming together is disheartening. If people can't see that only the lower classes are the go-to guilty parties for big situations, then we are done.

It’s a bit premature for that. This article is speculative clickbait that infers things about the investigation as if they’re fact.

If the DOJ brings charges against average Joe trader, then there should be outrage.

those 2 things are unrelated

if people were working together to buy shares to manipulate the price to induce others to join in, that can be interpreted as market manipulation

lots of people can be prosecuted under that theory

i don't think people who just bought will be in trouble

it's what they posted publicly

posterA saying "hey TD, i think this is a good stock because x, y, z" is one thing

posterB saying, "hey if we all buy this stock, we can get the price to increase and then others will join in" is potentially illegal
