Diminished Value claim

I’m in the middle of a diminished value claim. 2 day old car was hit by their customer ($5k+ damage). Admitted fault & covered repairs.
I had an independent appraiser determine about $8k and insurer offered $2k. Even CarMax puts the differential value at $4500.
I’ve sent this information to them and want to settle without filing suit, but they seem indifferent. I’ve made veiled threats that I have the patience and legal resources to play this out(which I do), but really do t feel like going through all of this nonsense, but it pisses me off to know my 2 month old car has a major blemish on the Carfax that I’ll have to pay for sooner or later.

Any thoughts on moving this along without suing?

Who is the liability insurer? Some are more difficult than others.

Where was your accident?

I went through a similar situation this year. I had not even made my first payment on my new truck, when a lady pulled right out in front of me. Did about $10,000 in damage, although all of it was cosmetic. New hood, bumper, lights, etc. I hired a deminished value guy for around $300. He said his calculations were that my loss of value was around $8500, her insurance offered me $2500 at first. Took truck to Carmax and their offer was around $9000 less than what the blue book value was on the truck. Other insurance company came up to $4000, but still not good enough. I ended up filing a claim with my own insurance company and getting around $6000. The laws vary from state to state, but wait the insurance company out and threaten to take their client to court if need be. The last thing they want is to pay some lawyer and have their customer chewing them out because they had to go to court over a slam dunk case.

This is why you always have the sore neck ace in the hole in your back pocket. You get hit, see a doctor for soreness afterwards just in case you have to play that card after the insurer gives you shite. It's sad but that's the easiest way to get a diminished value claim paid out without getting the run around. Insurance companies are so conditioned to paying a few thousand dollars for the most minor of accidents just to close them out that it's easier to do that than to claim diminished value because they'll fight you tooth and nail for that.

Go ahead and downvote the hell out of this post. Everyone knows this is 100% truth.

Truth or not it’s fraud. There’s a particular demographic who operates like that just looking for an easy buck

Progressive’s adjusters in Metairie, in general, suck. Try to get at or above 50% of your appraised loss and move on.

Their DV adjuster is out of Lafayette for some reason….
After I sent ACTUAL offers on MY VEHICLE with & without damage from CarMax showing a delta of almost $5k, they went up $200 with some bs about perceived value…
I HATE these Mother frickers…. All I want is what I can prove they owe me…

As an update, after they reviewed the actual offers I received on my vehicle with and without damage, they replied that “that was not I do it I’ve of market value” and stood firm on their previous offer.

Am I crazy or unreasonable?

Isn’t this the very definition of market value? “What a viable buyer is willing to pay an actual seller?”

Get a lawyer and a sore neck. It appears that the wreck has caused irrepairable harm to your sex life and marriage. Have your spouse get in on it also.
