This worries me or is just bad reporting. Yes, it does not say who will be charged with what (i.e. players v douches) but i havent heard anything that suggests the douches did anything approaching 2nd degree battery.

The police investigation is continuing and the release said police believe charges of second degree battery and simple battery will be appropriate when the case is concluded.

Depends on the severity of the injuries, I believe.

Lots of reporting on this has been suspect, but does it appear that the BRPD spokesguy is saying more than he should? Or is he being misquoted in the press?

maybe it will be concluded after the BCSNC next year!

It's nola so it's probably mis-worded. 'will' should be 'may'

Second Degree Battery
Second degree battery is defined as committing a battery where intentional serious bodily injury is inflicted. This includes injury which features unconsciousness, extreme pain, disfigurement, loss or impairment, or substantial risk of death.
A felony offense, second degree battery is punishable by up to 5 years in prison and fines reaching $2,000.

Yeah good question. Not sure why they would come out and say this.

The actual press release last night.
Again, doesnt say the players will be, but under what set of facts would the douches be charged with 2nd degree. This worries me.
The actual press release last night.
quote:
The four football players that have been implicated as being involved in this incident have not been charged with any criminal offense at this time. Our investigation has led us to believe that both Simple Battery and 2nd Degree Battery will be the appropriate charge when the case is concluded.
Again, doesnt say the players will be, but under what set of facts would the douches be charged with 2nd degree. This worries me.

Not likely

Exactly. Either the press release is badly worded or... well lets just stick with the press release being badly worded.

Team sweep!

I'm giving him the benefit of the doubt and assuming that he means, if the results of their investigation corroborate the victims' allegations, the appropriate charges would be simple battery and 2nd degree battery. Otherwise, he is pre-judging the case based on an investigation which he acknowledges is not yet concluded.

Kicking someone in the head would qualify for 2nd degree batter, but it is a DA and Police decision on what to charge and what to prosecute.

"It is possible arrests will come out of this interview and interrogation. It will probably be later in the week," Sgt. Don Stone explained. "We are pretty sure, probably 99 percent sure that the charges would be simple battery and second degree battery."
Quote from Stone prior to the meeting.... nothing rosy in this quote.

The Marine hitting JJ in the foot w/ his face, of course.

This. I know an officer on the case and he told me that charges would be carried out and warrants coming. (in his opinion)
It will be interesting to see if he is wrong.
