The last sentence on the Nola.com article bothers me.....

This worries me or is just bad reporting. Yes, it does not say who will be charged with what (i.e. players v douches) but i havent heard anything that suggests the douches did anything approaching 2nd degree battery.

Lots of reporting on this has been suspect, but does it appear that the BRPD spokesguy is saying more than he should? Or is he being misquoted in the press?

It's nola so it's probably mis-worded. 'will' should be 'may'

Second Degree Battery

Second degree battery is defined as committing a battery where intentional serious bodily injury is inflicted. This includes injury which features unconsciousness, extreme pain, disfigurement, loss or impairment, or substantial risk of death.

A felony offense, second degree battery is punishable by up to 5 years in prison and fines reaching $2,000.

The actual press release last night.

Again, doesnt say the players will be, but under what set of facts would the douches be charged with 2nd degree. This worries me.

Exactly. Either the press release is badly worded or... well lets just stick with the press release being badly worded.

I'm giving him the benefit of the doubt and assuming that he means, if the results of their investigation corroborate the victims' allegations, the appropriate charges would be simple battery and 2nd degree battery. Otherwise, he is pre-judging the case based on an investigation which he acknowledges is not yet concluded.

Kicking someone in the head would qualify for 2nd degree batter, but it is a DA and Police decision on what to charge and what to prosecute.

This. I know an officer on the case and he told me that charges would be carried out and warrants coming. (in his opinion)

It will be interesting to see if he is wrong.
