Even if the guy was defenseless, he was hardly "innocent."
This wasn't some decorated war hero. This is an idiot who had a restraining order placed on him by his ex gf who he stalked. And he also likely started all the crap in the bar.
Doesn't make it right to kick him in the head if that happened. But don't make it sound like this guy is a purple heart award marine.
