I know how the off sets work. As far as “looking” for a job, millions of people on unemployment “look” for jobs everyday. He could easily say he has decided to retire from coaching and LSU has to pay it all.

BK contract

Near the end. Schedule A, section 3. b

BK shall excercise due diligence for the length of the obligation owed to him. In other words, LSU has to keep paying him for the length of his contract and BK has to seek employment elsewhere for that term. He can’t simply say he retires. That’s the same as retiring from LSU and we no longer owe him. Again, it won’t get to this. LSU and BK will settle bc this is too much of a mess to try to fight over the next 6 years for both parties.

If Kelly has no interest in taking another coaching job, he should absolutely pull a Jimbo and just get those fat yearly payments for doing nothing.

Same deal Orgeron got too.

Stick it to LSU.

LMAO at LSU fans pissed that the man wants his money.....you should have never went after him in the 1st place. We, Notre Dame fans loved that you took him. You cant be mad at him wanting LSU to honor the contract.....you would do the same if a job hired you and there was a contract with guaranteed money.....let me know how many of you would say....naww, i dont want all that money after you got fired.

Yeah, I get that. You could be right in that he is unhirable. However, the onus is on him to try. He has to interview.

No he doesnt...he doesnt have to do a thing. Where does it say in his contract that he must look for other coaching opportunities?

He’s contractually obligated to seek employment right?

Yes, IrishDave…. he is.

The contract includes a duty to mitigate clause, meaning Kelly would be required to search for a new job if he were fired.

the baker....you dont understand how this works.....they may make Kelly look for a new job but they cant make him take it.....he can say I will take a new job for 25 million/year and no less and nothing LSU can do about it.....they cant make him take 250,000/year. Kelly has all the leverage.

It meets all the requirements....Kelly says I have my asking price and no one wanted to pay it.....LSU cant do shite about it. Simple as that.

As painful as it is... Jimbo didn't have a mitigation clause in his contract. Meaning he had no duty to mitigate. 100% mailbox money.

BK does have a mitigation clause, meaning he has a duty to find another source of income.

Sorry if I was an arse earlier. Had a bit going on.

He knows he will never have more negotiating power than right now. As long as it appears that LSU might not abide by its contract, how does that play for the negotiation with the next coach? Supposedly an incentive laden contract for the next guy, I would question the likelihood that I would get those incentive payments or would it all be re-negotiated when it’s time to pay? This is a bad look for LSU no matter how bad Kelly was.

He has to exercise due diligence and good faith in seeking qualifying opportunities. It’s in his contract. It doesn’t have to be coaching per se.

No kidding. CBK is a little man with a big ego that tells him he does no wrong.

Plus muh contract. Thanks Scott.
