because he didn’t hit them. He didnt hit the car behind them or in front of them and if this lady didn’t swerve he still wouldn’t have hit them
Funyons didn’t swerve to avoid him.
She swerved because she wasn’t going to rear end the car in front of her.

I’m just pointing that out. Maybe trying to help you. Because it’s clear you don’t have all of the facts. Have been unable to show proof the Kia driver was distracted, etc, etc. It appears like you’re trying to dig for reasons to make Lacy look better. And that’s ok. You do you. But I’m just pointing that out.

It doesn’t matter if she’s destructed or not, She didn’t leave herself enough time to stop safely.
Either she was distracted or she was intentionally did not reacting to the vehicle in front of her breaking or she was tailgating.
It doesn’t matter why she couldn’t stop safely, it only matters that she didn’t stop safely.
