Who gets to decide what message from a sitting president is a campaign message and what is just informing the public of what the administration has done? An unelected judge?

A President can use public funds for legitimate public service announcements and official government information. He can promote the country's agenda as well as his own by disseminating his message.

Right. That's the question. Is this legit public information or is it political advertisement.
The judgment might get reversed on appeal.
I was just pointing out the rage/grift of couching this in terms of whether or not the President can speak to his employers. It's a question of who should pay for these ads: his employers or his PAC?
