I just asked that. If defense had it they likely couldn’t publish it — and da didn’t have to give it to defense yet.

Could be why his lawyer kept telling him to hold on — I seem to recall lawyer saying they had something.

How would we know without him talking?

Could have been slowing down to turn. Could have been that he saw KL and slowed down as an alert driver. Could have been other things. BUT Funyun girl would have to be paying attention to know to slow down.

Ramming the gold truck likely would have been hitting another car sideways as she did.

It’s a low bar to indict bc the GJ is only used to determine probable cause and since the threshold to charge is quite low, naturally it favors the DA. Also there is no rebuttal to the prosecutor so they can exaggerate the facts as well to charge.

IMO if there was a defense attorney able to argue his view, it would drastically reduce the gridlock at regular court.

If Lacy was in the incoming lane of traffic 2 seconds before the crash, then in my opinion he contributed to it in a significant way.


It was more like about 4 seconds.

Accident actually happens 92 YARDS between my vehicle and collision. It’s is reasonable for a driver to slow down and drive into an oncoming lane of traffic with vehicles less than 100 feet away bc I saw a vehicle at least 2 behind them and over 100 yards behind (bc he had to be over 100 yards when driver moved in front of the vehicle immediately in front of her ). This is your theory of contributory negligence. This is your excuse for people combusting this kid in the media without objective evidence. This is your rationality of the initial blame you chose to place on this kid. Again , you either don’t care about the actual facts or have an agenda. There is no reason for a driver to turn into immediate traffic bc of a maneuver a vehicle made 100 yards and multiple vehicles back.

Completely wrong. It wasn’t until 92.something yards was he completely in the correct lane again and accident happened at 72 yards. At 45 mph that’s a fraction of a second. It times up exactly when the gold truck slowed/BRAKED and then woman swerved hitting the man oncoming

The lady behind him wasn't worrying about Kyren, she slammed on her brakes and swerved into the other lane because she was tailgating and not paying attention. According to the report, she was eating Funyuns and messing with her car stereo.

Anytime a driver is concentrating on eating or listening to music (or talking to a passenger or doing something other than giving your surroundings 100% of your attention) while driving and tailgating isn't fully paying attention to the road or what is going on around them.

The distracted driving law is specific to cell phones but there are other distractions that can take your attention off of driving carefully. Screaming kids in the back seat comes to mind.

It was 72 yards in front of him.

Regardless, the guy in the gold truck placed zero blame on Lacy and put all the fault on the lady driving behind him. He was driving under 30 mph. The lady behind him was tailgating and slammed on her brakes/swerved to avoid rear-ending him.
