Apparently the truck that the Kia Cadenza was following didn't slam on its brakes at all. The Truck's Event Data Recorder (black box) didn't record any braking. There also wasnt any skidding/tire marks that would be common with a truck driving at 45+ slamming on his brakes. He may have stopped pressing his gas and began slowing naturally. I believe even in his statement, the driver of the truck said that he did not press his brakes.
It's more likely that the Kia Cadenza was talking, eating, or generally not paying attention and finally noticed last second that she was about to impact the truck and decided to swerve into oncoming traffic.
Kyren Lacy was driving recklessly, for sure. The Kia Cadenza driver also wasn't paying attention and reacted poorly causing the head on collision.

This is incorrect. The “black box” data was from the white Kia, not the truck. And the truck driver never said he didn’t brake, only that he didn’t skid.

Was he not behind the wreck or was Moscona just wrong. I am really not sure you can cause a wreck if you were completely behind the cars when it happened and never struck any of them, confused here

And to be frank, attorneys have a code of conduct and can obviously mislead but will generally be sanctioned if they outright lie. Law enforcement on the other hand as expressly been allowed to lie to the public, to any suspect at any time and has been given essentially complete immunity for this as long as it is within the scope of their duty as lying is considered by the USSC to just be part of typical police work. See Frazier v. Cupp, 394 U.S. 731 (1969). This is why smart people never talk to cops without an attorney present ever

Notice the words in quotes? Those are the truck drivers exact words. He slammed on his brakes, and used his emergency brake. Thats a whole lot of braking

Yet the truck driver said he didn’t slam on his break, and the truck EDR shows he didn’t slam on his break but we are suppose to believe he did? And he didn’t see the car behind him swerve to avoid hitting him but let’s believe the lady that saw a car 70+ yards away on a two lane road but not see the car in the left lane lol.

so put the gold driver up on the stand under oath. (I didn't like the officer leading his statement either but now that I have seen the video of Lacey passing and how close he actually was to the accident, it's vivid he caused the reaction to avoid him.
"Sir, why did you get off to the right? was it to avoid the green car coming in your lane, yes or no?"
if no- what is your reasoning to slowing down and getting off the shoulder o the road which doesn't really exist, you're under oath so choose your words carefully because you're about to be questioned for strange wreckless driving, and leaving the scene"

I’ve read your arguments and fully understand them. However, just playing devils advocate: Is LSP civilly liable for Lacy’s death? Following your logic(which I don’t disagree with, necessarily), had the LSP not overcharged him, he likely wouldn’t have killed himself.
I don’t think you can hold people responsible for how poorly others react to things.
Lacy was driving recklessly and speeding. The woman was speeding, distracted, and following too close. He should have been cited for his part. Ultimately her inability to follow the law and react appropriately caused the accident. Had a squirrel run out in front of the truck and he slammed on his brakes and the same thing happened, would she have been cited with a single ticket? Would they go after the squirrel?
There are a lot of analogies you could make here about cause and effect and the butterfly effect is limitless.
