The problem is that per NCAA rules, LSU can not license anything that specifically identifies a player. So if LSU doesn't license it and you use the letters LSU, or any of the LSU logos, etc, they you are producing/selling unlicensed merchandise.

The number 7 by itself is okay to produce. You can make all of the shirts you want with a 7 on it.
However:
"Honey Badger" + "7" = "Tyrann Mathieu"
Is there anybody else that those two items reference?

(3) Combination of Honey Badger and the number 7 is NOT okay.

In all seriousness, I've been around enough bogus legal claims & actions over the years to spot a duck when I see one. This is a power grab by LSU, and the lawyer that wrote it knows that most of the claims are bogus, but is throwing everything against the wall to see what sticks. If you wanted to spend a little money with a lawyer, they'd back down pretty fast. Of course, no TM7 t-shirt is every going to sell enough to make it worth your money to hire the lawyer to begin with. The lawyer that wrote this knows that. Tis the f-ed up legal world we live in.

Your fantastic legal experience aside, you completely missed the point. It has nothing to do with LICENSING. This was LSU compliance coming out and saying the sale of those T Shirts could cause trouble from a compliance standpoint.
No way LSU would be able to sell the honey badger shirts even if they wanted to license them because of the compliance issues. This isn't LSU wanting their cut. This is LSU covering their arse.

Its because likelihood of confusion that it can be associated with a particular player and be an "official LSU" likely shirt

it's not a copyright issue or remotely related to it. LSU is not claiming rights to profit off of the name, number, etc. it's an ncaa issue and it appears that they are not allowing a player to be used to develop a brand name while an amateur. sounds like a good rule to me; the interpetation and enforcement may not be perfect but i think the rule actually protects the players and the university and the ncaa.
