If you were a victim, or suspect in a case wouldnt you want the police to do everything they can. Including interviewing all witnesses

yeah. there's a huge fundamental difference in assault and battery. Assault is just placing someone in the reasonable apprehension of receiving a battery. Take a punch at someone and miss and you've assaulted them.

so, in regards to the 3 fracture vertebrae.... what no one in here knows is what type and how bad the fractures are. If he was released in a few hours it is highly likely they are small fractures that are not acute. If the fractures would have been acute and needed surgery, then thats a whole other ball game. But, they could be as simple as an avulsion type fracture... Fracture is a very loose term, and yes I do work in "the field". Just to add.... could also be small non-displaced fxs.... with a specific type of fracture is the only way you can determine how serious it is.....

The point of any investigation is to get as much info and testimony as possible before making any final decision

Everything you just posted is complete hypothetical and had nothing whatsoever to do with my original post.

The fact that a person has 3 fractured vertebrae does not automatically translate into intent, or reasonable expectation. You are crazy if you think it is. If you punch someone in a fight, and they fall in an unusual position and fracture vertabrae, you will not necessarily be charged with aggravated battery. How can you say that it occurred as above?

So I'd imagine that actually getting hit can be construed as assault then. I mean, if someone swings at and hit me, I'd see that as being placing someone in the reasonable apprehension of receiving a battery.

Bottom line is a know it all such as yourself should have been able to figure out what I was saying without being a douche about it.

If the police already had the evidence needed to charge or arrest them, would they have done it today?

IMO, interviewing 10 more half drunk kids isint gonna turn up any new evidence that they havent already heard over and over.

There is nothing unusual about this investigation. There have been accusations made against four players. Under these circumstances, law enforcement cannot make an arrest unless a judge or magistrate deems there is probable cause to issue an arrest warrant. A warrantless arrest of one of the suspects without probable cause would be a Fourth Amendment violation. For all we know, the BPRD is prepared to make an arrest but has been unable to secure an arrest warrant (i.e, to convince a judge or magistrate there is probable cause to arrest a suspect on the charges). Believe this, if and when a judge issues a warrant, an arrest will be made.
