Two things in the story jump out at me. First, Moore says that they want witnesses to testify under penalty of perjury. This tells me he wants to use the GJ as a preview of how witnesses on both sides of the case would hold up at trial. I've always believed that the outcome here would be decided not by waht did or didn't happen, but by the strength or weakness of the (especially prosecution) witnesses.

Second, Bienvenu's reference to civil proceedings says a lot about what's driving this from the standpoint of the alleged victims. Not that we didn't know that, but his direct reference to it really struck me.

Not sure about Johns, but Jefferson probably has a legit case against BRPD with the way they used his name to get in front of the cameras. It seems they were very happy to let it play out the way it did.

He didn't start a fight. He didn't engage in the fight. I'm sure he would have rather walked away. However, he helped pull LSU players away from the fight.

Would you rather a leader just walk away from his teammates?

But if the chareges are dropped because of not enough evidence, is that enough to sue? I mean I could see if it went to trial and found innocent. Just asking.

I can't say whether this is accurate or not, but you seem pretty confident.

There's no case against the BRPD. They have qualified immunity. They have probable cause based upon Lowery's statement.

Now Lowery and his paramour, on the other hand . . .

There is no physical evidence so witness testimony is the only thing to base the case on.

If I'm Jefferson I would file something against Lowery,witnesses & BRPD. They've put him thru hell and damn near ruined his name.

FWIW, can we throw Jacquez Doucet of WAFB in the mix also. His "marine kicked in the head" comment didn't help JJ at all.

You have to show intent and maliciousness, which probably doesn't exist in this case.

You can't collect damages from the police for incompetence.

I don't know if JJ did anything wrong nor do you,so why say that? He hasn't been a problem from the beginning of his career at LSU. One night out with the boys and it about ruined his entire life??? That's unfair!!! Wrong place, wrong time??? Haven't you ever been in the same predictament? I'm a JL fan all the way and I'm still saying this!!! I just don't understand why people keep slamming JJ!!!

SO you've never been in a fight and neither have your family/friends...sure

Also, the whole referring to them as "animals & thugs" is extremely played out and weak.

The witnesses who will testify against the JJ's are extremely credible. I'm familiar with the interviews and they've convinced the DA's beyond a reasonable doubt.

Jefferson's story has changed several times, and he is very incredible. And if you believe anything Unglesby says, you should think again.

That said, the DA's don't believe 2nd degree is the way to go. There's no evidence JJ was involved in the anything other than the kicking of Lowery, who didn't have bad injuries (a microfracture to face). Hard to see "intent to inflict serious bodily injury" there.

The GJ will return simple battery. JJ will plead and get PTI, have it wiped from his record, and never play football at LSU again.
