we also don’t HAVE to pay him 54 million today.

So again, there is no rush to figure this out.

He could get more if he took the $30m settlement. Let's assume he finds another job making $5m per year (which is reasonable in today's market) on a 6-year contract. That's $30m from a new employer.

If he takes that job without accepting LSU's offer, the $30m in new salary gets deducted from the $54m that LSU owes him. He still nets $54m ($30m from new employer, and $24m from LSU).

If he takes that job after accepting the $30m offer from LSU, he gets $60m ($30m from new employer and $30m from LSU).

Therefore, a $5m per year job is likely the decision threshold between accepting or declining the LSU offer. Below that, decline; above that, accept.

His declining likely means either a) he doesn't intend on coaching at a top-end school or b) he's going into broadcasting.

$54M to BK is $54M that could have gone to the next coach and his roster

Wow, no one who actually contributes the money must have ever thought of this

Why is Kelly the one being a jerk? The reason we have contracts is so that someone will have to keep an agreement. From my vantage point that someone is LSU.

If I was Kelly, no way I wouldn’t get my money. LSU agreed to it.

He signed the contract, too. He has an obligation to get his arse off the couch and go get a job to reduce the buyout. Or he can take a settlement. LSU will not pay out the full $54M. Woodward knew that when he fired Kelly.

Duty to Mitigate. In the event of termination by LSU without cause, the amount of liquidated damages owed by LSU under this Section shall be reduced and extinguished by and to the extent of any compensation Employee earns, receives, or is entitled to receive for football-related employment, whether intercollegiate or professional, including coaching, administration or media, from any third party from the termination date until LSU's obligation pursuant to this Section to Employee terminates or ceases to exist. Employee shall exercise due diligence and good faith in seeking qualifying employment so long as the liquidated damage obligation exists. In the event Employee obtains such other employment, Employee must notify LSU and provide documentation reasonably requested by LSU to determine the amount of compensation received by Employee and the amount of offset due to LSU.

How do you know he’s not trying to find a job? Sounds like you want BK to agree to a low ball settlement offer not knowing what job he may possibly land. Only a complete fool would do that.

However, he failed. He overpromised and underdelivered. He put an awful product on the field, regressed in his last year, disrespected LSU fans, made himself look like a jerk in the media etc.. Just take your 30 million and ride off into the sunset. I understand he signed a contract, but the reality is he sucked in every way. Pisses me off that he’s fighting so hard. In no other profession would his work result in 95 million dollars. Brutal.

I am not a lawyer
I don't know the contract terms

what I do know he is checked out on doing his job and we have receipts

I hire a lawyer and play hardball with him

drag him through the papers

show the world why he failed...and broke his obligations

surely we didn't write a contact with some obligations?

I'm responding to idiots who think LSU owes BK $54M and BK shouldn't settle for less b/c he can simply stay home and collect a big check. That isn't the way the contract is written. If anyone here would bother reading the contract, they would know that.
