But isn't that rule superceded by the transfer portal and the waiver of the one-year residency? For instance the rule mentions the one-year residency (meaning the player would have to sit out one year at his new school) but the NCAA abolished that with the one-time transfer waiver.

Let me repost & include this first part too. Once a player signs a NLI, they are with that team for 1 yr. Only way out is to request a full release, which can be granted or denied.

I respectfully disagree. The sole purpose of the transfer portal is so kids don't have to get a release from their present school before transferring. Otherwise, there's really no reason for the portal.
The portal is a separate issue from the waiver of a year in residence. The year in residence doesn't refer to their present school, it refers to the school to which they transfer. It simply means they would be ineligible at their new school during their "year in residence."
The NCAA then tacked on the one-time transfer waiver that did away with intelligibility for that one year in residence requirement.

Okay, I see. What's confusing to me is, what's the use of the portal and waiver if they still need a release?

What's the use of signing a national letter of intent if they can head straight out the portal? Gotta draw a line somewhere. Athletes are only bound by the NLI for their first year. Can hit the transfer portal as a SO or RS Fr.

Problem with the comparisons to free agency aren't even close, unless you start having them sign legally binding contracts or reinstate the 1 year residency the transfer portal is going to benefit the Elites. Small schools are always going to be on the bad end of this.
If a major university was smart their priority would be making a multimillion dollar fund under an nil and recruit the best sophomores each year.
