Irrelevant. Either your waterproofing works or it doesn’t.
Nothing at all wrong with redgard (two coats) over CBU.

Yep tape the seams and apply RG. A lot of people don't know how to install the Schluter system despite saying they do. On top of Schluter itself being expensive, installers also charge about double to install it vs the other ways of waterproofing.
Whoever built my house sunk in the shower pan and put in the vinyl liner 20 years ago. It still leaked because they did a crappy job. We relined it properly and then built the pan back up with 4 to 1 Mud Bed mix and tiled over it.
Everything I did was still cheaper than overpaying for Schluter and I promise you it is just as waterproof if not more so.

The builder is free and clear at this point. He could easily argue you didn't regularly reseal the grout leading to the failure.
I know nothing about this, but what if it was due to negligent installation. As in you hired them and they didn't install to code? I get that time has expired on a faulty installation. Or that failure is going to eventually happen even on properly installed things. But if they do the job wrong, but it takes several years to destroy your house, it still seems like their is fault due to the negligent installation?

You usually get one year, faulty installation or not. Some people knowingly cobble things together so it looks okay and will last at least a year before the homeowner starts noticing signs indicating there is a problem, or problems.
A reputable installer will warranty his work forever. Others, not so much.

OP still needs to understand that not waterproofing and a tile falling off are not necessarily related. Waterproofing goes between the tile mortar and cement board. The waterproofing doesn’t have anything really to do with the tile falling off or at least it shouldn’t? Waterproofing has to do with the water getting behind the cement board, tile falling off is in front of the cement board.
In other words, a tile could fall off and it still be waterproofed normally.
There’s all different brands of waterproofing. Redguard is just one brand and is red, there’s yellow and blue and probably others.

Exactly correct. Thin set could have skinned over, no expansion gap in the corner, insufficient coverage of mortar on the back of the tile, to name a few.
Waterproofing in the form of 4-6 mil visqueen could also be behind the cement board, instead of a surface applied waterproofing.
Sounds like you’ve set a few tiles yourself.

Anything around water should be red guarded IMO
It is a fantastic product I did it on all my exterior windows and openings.
They make a blue/ greenish color for roofs and exterior OSB.
It's expensive but I won't have a leak

I just had to replace our master shower due to a failed schluter system.

I have to disagree. The Schluter system did not fail. It will not fail. It was installed incorrectly.
