City of New Orleans sues owners of St Roch Market

Looks like the guys at St Roch are being sued by the city over their new food hall the opened in Miami under the same name. City claims they own the name (which seems blatantly obvious since they owned the building bearing the name and leased it to the food hall owners).

Going to be fun watching them sue every business with "bourbon street" "big easy" "new orleans" or other similar themed names around the country.

well those words would seem to be in the public domain. hard to enforce.

But unlike those examples, the city actually does own the St Roch Market.

Again, those would be considered public domain. St Roch Market is not.

Except the city doesn’t own a French Market bistro or a French Market coffee.

I think the issue is that someone is opening the exact same thing by the exact same name.

The city doesn't own anything going on inside St Roch. Not the concept nor the operation.

The city owns a building called St Roch Market.

Thet are suing over the use of the name. Which is absurd. It doesn't diminish the value of the recently renovated building.

The Miami operation is a restaurant named 'St Roch Market' using the operator concept. So they opened a restaurant named after a building in New Orleans.

Always follow the money.

Meanwhile, maybe the litigants can appeal to Saint Roch for arbitration. After all,

Maybe the Catholic Church should sue the City of New Orleans. After all they canonized him as a Saint.

Simple mistake. I phone corrected the abbreviation street and rock to graphic artist. Actual name of new establishment street rock.

Technically, they leased a piece of property to the food hall owners. The leasee merely used the historical name of the property they leased.

If the city wants to go after a group due to their name, New Orleans Hamburger and Seafood Company better watch out.

I think the problem is the trademark. If the City doesn’t contest the trademark, then these guys could file for incontestable status after 5 years. Once that happens they could leave the actual operation of the st roch market and own the rights to its name, so any future operators including the city would be infringing on the trademark.

Probably right on the trademark. They should both agree to not trademark it
