They're going to do it, because they can't help themselves, but I think it is both terrible optics AND they could easily lose. Kyle's testimony in the murder case pretty much said, yeah, he gave Black the money, but they were keeping it in Wisconsin and waiting for him to get his Illinois permit before doing the transfer. Textbook following the letter of the law.
It would be difficult to establish the requisite criminal intent under this fact pattern. (I'm not an expert in this area, by the way.)
