Gov. Kay Ivey issues executive order taking aim at Biden vaccine mandate — ‘Alabama is standing firm in this fight’
The governor gives a strongly worded denouncement of the mandate and her E.O. seems to back it up. Good for Ivey.
Section 2 is the money shot. The opening sentence explicitly forbids any state entity from penalizing businesses or employees for noncompliance with Biden’s E.O. Excellent.
Yet the last sentence is concerning. I’m not sure of the intent here, but it seems to leave open the possibility that if Congress passes a law requiring vaccines, the State simply will say it does not endorse such laws.
The State should assert it’s rights and say any such laws about vaccine mandates are no business of the Federal Government. This further seems to contradict her media statement that no one will be forced to take the vaccine as long as she is Governor.

Wish we had a governor with balls. She isn't the worst, but she is a definite follow the leader in terms of waiting to see what is popular before making a move.

This seems like a pretty toothless EO that just says that the state of Alabama won't impose any penalties, and basically that they don't condone the federal mandate. It even says that federal penalties may still apply.

The 2nd part specifically refers to a law — that means legislation duly passed by Congress. Biden’s executive order is not a law and exceeds the scope of the president’s authority.
Biden’s X.O. on vaccine mandates is ex nihilo and contrary to Alabama’s existing law on vaccine mandates. The difference between Biden’s X.O. and Ivey’s X.O. is that the governor’s X.O. is simply reinforcing an existing State law.

Now why can't Texas Gov Abbott say he is going to stop Biden's illegal immigration plan and close the Texas border not not allow anyone in. SAME THING!
