A detention center officer in New Mexico filed a lawsuit over a workplace requirement to receive the coronavirus vaccine, the first lawsuit against mandatory COVID-19 vaccination in the U.S.

The detention center officer, Isaac Legaretta, sued a county manager and his supervisor on Sunday, Bloomberg Law reported. The officer’s attorney, Ana Garner, said he was told he would be fired for refusing inoculation.

The complaint claims the county manager and supervisor violated his rights by making the vaccine a condition of employment for first responders unless reasonable accommodation has been approved.

“You can’t be forced to be a human guinea pig when a product is experimental,” Garner, an attorney for the nonprofit New Mexico Stands Up!, told Bloomberg. “We have the right to bodily integrity.”

The county attorney has disputed the allegations and argued that the Centers for Disease Control and Prevention and the Equal Employment Opportunity Commission (EEOC) said employers can mandate vaccinations.

I don't think either of them have the statutory authority to do what they claim... Especially the EEOC...

Weird. I don't remember voting for the CDC or EEOC, or havibg anything in my employment contract about my employer dictating what I have to put into my body (there are things that I can't put in my body, but nothing that I have to put in).

frick off with that argument.

Who gave CDC the authority to put a moratorium on evictions?

These lawsuits that appear to be against mandatary vaccines can be nothing more than a mechanism to validate mandatory vaccinations.

All these nuts need is some court somewhere to say it's ok because we are in a pandemic.

If this doesn't show everyone that the EEOC and OMB is actually against employees and employers I don't know what will.

They've now hinted or said it's not really a vaccine, kind of like the flu shot is not really a vaccine, either.

So this is BS. He should win his case.

He will lose.

Schools require proof of vaccination.

The military is basically a petri dish for medical trials.

Our country does not value liberty.

He will lose.

Well it’s either go to the courts or get terminated. I would fight it tooth and nail. The real problem is our expectation that the judges don’t value or view our liberty as the most important thing. It’s scary.

I read in a thread here that 1/3 of the military had taken it ... someone question why more hadn't and asked it was madatory.

Someone else posted that as long as it's approved for "emergency use" that it can't be mandated.

Sadly, this, as far as I can see, is true.
