The fact that they CHOSE not to EXERCISE that authority does NOT change the nature of the warrant
It is certainly indicative of their willingness to lie in order to get what they wanted from the judge. If they were willing to lie (under oath) to a judge, what else are they laying about?

None of the officers involved in the raid were involved in obtaining the warrant.

The DA did not solely rely on police testimony/accounts and neither did the grand jury.
