Even if someone breaks into your house and they have a weapon on them? In other words, even if its obvious does it still go to court?

Criminally you may be good. But defending the wrongful death lawsuit brought by the family will cost $$$$ to defend. Even if you "win".

Yes the Harris County sheriff specifically gave this scenario when discussing this. All it takes is one family member of the perp to launch a lawsuit. It would be a civil case that you would have to defend. The criminal court would be fine with the killing.

In LA there is no duty to retreat, many slave states.. not so much, your first duty is to retreat (yes that can mean leave the premise and give them your shite). Depending on the DA you may have no other rights.
