I set up a gun trust back in 2016 with my brother and bought 2 cans right away. I’m looking to get the process started on a couple more cans and just wondering if any thing has changed on how to purchase them since then. I did some research but everything is pretty vague. I’d prefer some real world experience from someone that has bought a can in the last year or so.

I bought my first ones at the counter at Bowie’s, so I’m also unsure about purchasing one online from out of state.

Any info on the steps is appreciated.

41f or the “new rules” breakdown LINK

Find a shop around you that has a SilencerShop SID kiosk is my recommendation. Makes the process painless.

They have a store locator on their website. You can set it to search by zip code, and check a box for "Has kiosk".

-Everyone listed as a trustee on the trust documents will have to supply fingerprint cards, passport photos, will have to answer the responsible persons questions, and will have to pass the background check. Beneficiaries do not. That's the big one. You used to just supply the trust documents.

-The CLEO no longer has to approve anything. You are required to notify them that you're submitting a Form 4 and just send them a copy of the Form 4 and responsible persons questionnaires you're submitting.

-If your trustees are spread out, SilencerShop's kiosks can handle the fingerprinting and their app handles the passport photos. The rest is just filling out a form that SilencerShop sends you when it's time to send the Form 4 off. That's if you go the SilencerShop route.

-You could always remove all of the other people as trustees if you're the guarantor, then buy new items once you're the only trustee left, then add trustees back after the items have been received and are listed on the trust's property addendum. For that year until the items come back, though, they'll not be able to take possession of the existing items in the trust. I'm not sure what the legal situation would be if you removed them, sent the paperwork off to the ATF for the new can, then added them back before the Form 4 was approved. You're gonna need an attorney to answer that one.

As for purchasing from out of state, it's pretty simple with SilencerShop. They handle everything from end to end and you don't have to worry about any of the paperwork. You can still buy from out of state from other vendors, but it may not be as easy as SilencerShop because SS has the kiosks for prints, app for pics, and the variance from the ATF to use electronic signatures. If you buy from other sources out of state, they may not handle the Form 4 and you may have to do all of that yourself or get your local FFL to do it.

Anyway, here's the breakdown of how it works if you use SilencerShop.

1) You pick out the can you want from their website and pay for it and the tax stamp. You upload your trust documents and use their kiosks and app to handle the fingerprints and pictures.
2) SilencerShop electronically requests a Form 3 transfer from the ATF (SOT to SOT) to transfer the can you bought from their inventory to the inventory of their local FFL affiliate you picked.
3) When the Form 3 is approved (in a few days, usually), SilencerShop sends the can and a check for the local FFL's cut of the deal to the local FFL. When the local FFL receives the can it's legally in their possession as far as the ATF is concerned. At this point, if the FFL you chose allows it, you may have conjugal visits with your own property.
4) When the Form 3 transfer is complete and the LGS has received the can, SilencerShop fills out the Form 4 to request transfer from your local FFL to you. They send a copy of all the paperwork you need to sign to all of the trustees and a copy to the LGS. SS has a variance from the ATF allowing them to use digital signatures, so all of this part is done via email for electronic signature through Docusign. You get the email, digitally sign the attachment, and you're done.
5) Once SilencerShop has the digital signatures from all parties and all the prints and pics from trustees, they send the Form 4 and all the required prints, pictures, trust documents, etc., off with the $200 for the tax stamp to the ATF. In about a month, SilencerShop will see that the ATF has cancelled the check they sent and will notify you of this. At this point, your Form 4 is pending with the ATF and your interaction with SilencerShop is over for this transaction. As far as the ATF is concerned, after SS did the form 3 transfer to the LGS, they were no longer party to any of this. Handling the paperwork for the Form 4 transfer between the local FFL and you is part of the service that SilencerShop provides to make purchasing the can less headache for the buyer. If you look at the Form 4, your local FFL will be listed as the transferror, not SilencerShop.
6) Wait.
7) Wait some more.
8) Still waiting.
9) The approved Form 4 arrives at your local FFL. They call you and you go down there and fill out the standard 4473 to transfer a firearm and they hand you your can and tax stamp.
10) Pew.

There is a place in Metairie called the Meplat Group that operates similarly to the SilencerShop. You have to go to them to get fingerprinted and have your picture taken, but after that, you can shop with them completely online and they handle everything for you end to end like the SilencerShop, have the same variances with the ATF to use the same signature process, and you don't have to worry about any of the paperwork. Might be worth contacting them if you're considering buying multiple items and would prefer working with someone more local that you will actually meet in person when you go to get prints and photos.

Dude thank you so much. There was more information in your post in plain English than I could find in an hour of research.

I live on the Northshore and I see a kiosk in Covington and in Metairie. So all I need is to submit fingerprints and passport photos and have my brother do the same and then it’s regular online shopping with a longer wait. Thanks again!

Let's say if I have one thats been in NFA jail for 3 months. I buy another suppressor. Would I likely get that 2nd stamp approved along with the first stamp at the same time?

Not likely. They process them in order received.

Maybe. Maybe not. Batch approvals are definitely a thing, but there doesn't seem to be any rhyme or reason to when they happen or how they're triggered. I suspect that it happens when you get an examiner that gives a shite about the people and does a search for other Form 4s from the same name/address to cut workload and get them all done at once. On the other hand, you might get an examiner that only does the one in front of him and you won't get batched. So much of this NFA process comes down to how much of a good guy your examiner is. I did an SBR recently and got an email from my examiner that said my photo was corrupted and told me how to update it. A half hour later, I had my approved Form 1 in hand. I've read stories of people with the exact same corrupt photo problem where the examiner just flat rejected their application and made them start all over. There is no rhyme or reason with the ATF.

I'm 60 days in on three cans; one from SS, two from Meplat. Maybe I'll be lucky and I get a batch approval and it's only 120 more days to go! Or maybe it'll be 240-300 more days and they'll come in random order. Who knows?
