Not really

According to Viva Frei's show last nite, this would likely both (a) strike down the mandamus but also (b) mark Sullivan as a party and therefore trigger an immediate recusal

That would result in a reassignment of the case to a new judge who should call for immediate dismissal

However District Judge Amy Berman Jackson is also in that district. Should she draw the case, who the frick knows what she will do. She has NO qualms about running this thing through the ringer and starting this all over again.
