Gorsuch is right. There standard is not applied evenly and as a result, it makes it so you can gamble or watch movies in public but not worship God, which is supposed to be Constitutionally protected.

Frankly, I'm over the love affair with Gorsuch. He writes a good, short opinion every now and then, but people forget he literally just judicially updated Title VII and declared half of Oklahoma as Indian Territory.

He's going to be battling the Chief soon for crossover awards.

Not funny. It is based on reason and equal justice under the law. But I see. That comes out of the Supreme Court so rarely these days that those terms seem humorous in association with that body.

It’s incredibly sad, and TD is the only place I’ve seen it discussed since it came out Friday night. People have no clue.

Here is the opinion from a similar case two months before with the same outcome. What states realize is that you can‘t tell people how to worship and enforce that because that would be unconstitutional. Instead they are limiting occupancy and letting people worship however they want. States can write Governors orders for restaurants on all kinds of required safety measures and fine businesses if they fail to follow those orders. There’s no way for government to tell a church to not drink from a shared cup and fine them for doing so.

It’s a pragmatic decision. The court doesn’t want to approve an injunction for emergency orders during a pandemic when churches are still allowed to operate.
