Why doesn’t the platform act as a platform, rather than a publisher? And why doesn’t the platform uphold their own rules, rather than censoring ideas and philosophies that it doesn’t agree with? And if it intends to censor content and ideas, simply because it disagrees with that content and ideas, how can it possibly maintain the outright lie that it is simply a platform?

The dominant social media companies must choose: if they are neutral platforms, they should have immunity from litigation. If they are publishers making editorial choices, then they should relinquish this valuable exemption. They can’t claim that Section 230 immunity is necessary to protect free speech, while they shape, control, and censor the speech on their platforms.

Exactly this.

It will be interesting in the future if someone goes after FB due to their actions as a publisher. This isn't it IMO, but it will be hard for FB to describe their actions as a platform and not a publisher.

It damn sure trends that way. Is there an example of the judiciary just creating conservative policy that failed at the ballot box? There’s got to be something, although nothing of the magnitude of abortion or gay marriage.
