Does this scare anyone else?
After him inventing a tax to make Obamacare work, what the hell is he going to do presiding over an impeachment trial.
Maybe invent some new evidence rules? Will he allow hearsay, maybe even hearsay within hearsay?

The Chief Justice's function in the impeachment trial is not as powerful as you think it is. The Senate is running the show, not him.

I read somewhere that there is potentially a ground to recuse him...though I'm not sure what it is. If that happens, then next in line is....wait for it.......Clarence Thomas!!! Now that would be something.

Is this really true? They are the jurors. Now the whole charade at least becomes a trial with evidence and cross examination and defense witnesses. And Roberts is the judge. He will do what federal judges do and command the courtroom, rulings etc. This whole thing is going to be a mess.

Senate trial is unique in that the Senators can over rule a Roberts decision.
Hypothetical.....Roberts blocks the calling of Schiff or Joe Biden.
Republicans try to over turn that but all it would take is Romney and 3 buddies to back Roberts on that or any other matter.
A few Republicans can and will block anything that's a favorable set up for Trump.
Romney may not have enough support get Trump removed but he probably has enough to prevent Trump from going scorched Earth like everyone seems to think will happen.

No. The Chief Justice is acting as a trial judge. He will be ruling on evidence and instructing the Senate in the applicable law.
What I am more concerned about is the applicable burden of proof. I understand that the Senate determines this. I would hope it is at least “clear and convincing” and since it’s quasi criminal would prefer “beyond a reasonable doubt”.

Apparently, if Roberts makes a ruling, then 50 Senators can overrule him.
Not sure what the balance is in the Senate, but this could come in handy on things like what witnesses can be heard....

Holy crap, you are correct.... If Roberts is recused then Clarence Thomas is next up to the plate.
Wow, maybe Roberts public criticism of Trump would be sufficient indication of bias for recusal.

It's not a criminal trial, it's political. The FRE and FRCP do not apply. This is not a traditional court case. The worst that can happen to him is that he will be removed from office. They would have to go further after that with actual criminal proceedings to get him in prison.

Roberts was blackmailed by Obama.
Supposedly the blackmail is no longer in play. Time will tell, but I'm not worried about Trump being impeached. It won't happen. And if it does happen, it will have been part of the plan.

Wrong. He invented no such tax. Said tax was part of the legislation. He rules that the federal government has the ability to legally levy said tax.
The stupid arse republicans were legally out maneuvered by the democrats and that is what stuck us with Obama care.

Well actually, Roberts went with the libs because the fine in Obamacare was designated as a penalty, not a tax. Technical language won the day in that case.

Ok...a simple majority of the full senate can overrule any ruling made by the chief justice. That makes me feel a little better about it. So, if the repubs stick together, it may not matter who is the presiding judge...
