This is useless now that they can obtain a warrant for your blood. So then instead of your license being suspended for 6 mos, you get it suspended for a year. They will get your BAC regardless.

I think the distinction is probably indicated by the phrasing "under the influence" vs "while intoxicated". I could drive a vehicle under the influence of alcohol but not be considered intoxicated until I crossed a BAC threshold.

I get that, but it still changes from "driving" to "operating'. It's just odd that they both aren't "driving", I'm sure it has to do with being able to bust you for sitting in the car with a key in the ignition while drunk or some other non-driving activity that could be considered "operating" a vehicle

its a money pit. Dont blow. get a lawyer. fight it in court. win. get a interlock ignition device if you want to drive and they take your Drivers liscence (which is 100$ to calibrate every month). It sucks spending multiple 1000s trying to get clear but it is worth if you do frick up and drink and drive. one advice.. Call a fricking Uber!!!

I almost did in Texas.
Was pulled over by green jeans in a low powered motor boat.
They brought me back to land and performed a sobriety test.
Since I was compliant, and had a sober ride waiting for me on land they let me go. But also stated that the motor was so low powered that it would have been like getting a owi on a lawnmower.
I thanked the hell out of those guys

It makes sense if you know what the acronyms actually stand for.
DUI - Driving under the influence
OWI - Operating while intoxicated

Yeah, that's why I said the phrasing going from "driving" to "operating" was odd. Thanks for clearing up the difference between under the influence and impaired for me though

The title of 14:98, et seq. in Louisiana is "Operating a Vehicle While Intoxicated." The only enhancement/increase in severity is based upon BAC or multiple offenses, and it's always Operating a Vehicle While Intoxicated.
There is no formal "DWI" or "DUI" in Louisiana unless you're referring to a municipality' ordinance used to sometimes cut people breaks. But neither would be more severe than the state statute.
