DACA is not signed law. It's merely an Executive Order. Until the libs came charging over the hill with their army of lawyers, it was totally understood that any POTUS could countermand a previous administration's EOs with the same stroke of the pen as created it by the predecessor.
When libs can't win, they go to the courts.

Oh I completely understand and agree with that.
What I dont understand is where that opinion of why it would fail the courts came about. Like is that an opinion that was pulled out of thin air or legitimately argued

No. In my mind there are three questions:
- Can Trump countermand Obama's EO. The answer is probably yes.
- Was DACA constitutional? maybe or maybe not
- However, you have these people who applied for protection under DACA because Obama issued that EO. Should they continue to receive that protection? Probably yes.

It's a goddamned executive order.
A subsequent President has an ABSOLUTE RIGHT to undo or reverse the EO of a predecessor. To conclude otherwise is to imbue a president with lawmaking authority - which is anathema to the constitutional separation of powers.

Did I say otherwise?
The issue I am pointing out is that its going to be difficult to deport the people who were approved under DACA because they relied on what the government told them under the previous administration.

Do you notice how NO Liberal justices ever break ranks on important issues or even turn into moderates, much less conservatives...
...but the list of Republican-nominated justices often turn moderate, liberal or side with liberals on big issues (Souter, Roberts, Kavanaugh/Gorsich occasionally.) Ford nominated John Paul Stevens who turned out to be one of the most liberal justices in the last half century.
And yet every time a Republican president gets to nominate, the press/dems scream about not having litmus tests (or that they're sexual predators/harrassers...whatever it takes to destroy them).
