This is a truly strong decision that needs to be built upon. Great ruling. True ruling.

Anti-Christian Bigot RBG was one naturally.

Just a reminder that Jews make up 2% of America but make up 33% of the Supreme Court.

Did either of the two battle axes offer up a dissenting opinion? I’d love to see how they rationalized their vote.

Yeah, it will come in real handy the next time you have a religious symbol that doubles as a national monument.

For example ... ???

OF COURSE it doesn't violate the Establishment Clause, it passes the Lemon test with flying colors, the point of erecting it was to honor the men who died even Jewish men who didn't object to the erection of a cross, not to inculcate a religious sect, the citizenry didn't think it violated 1A then absurd people think it violates 1A now bunch of ungrateful leeches

Their rationalization couldn't have been worse than Alito's.

Can't promote religion but can't hurt it either, the Court struck this memorial down they'd be endorsing the infringement on 1A, it is what it is. SUCK IT, LIBTURD.

Wrong. "would not be neutral and would not further the ideals of respect and tolerance embodied in the First Amendment.”

What exactly are the ideals of respect and tolerance embodied in the First Amendment? Sounds like the gobbledygook used by "activist" judges when the law doesn't fit their political leaning.

Were Breyer and Kagan “activist judges” in this ruling, too?

Not destroying or defacing a cross that stood undisturbed for nearly a century I'd presume, it's in your Justice Alito quote, bro. Look the Memorial Cross clearly passes the Lemon test no ifs, ands, or buts, it's done. I'm personally an accommodationist when it comes to the Establishment Clause, can't show preference for a religious institution over another but can promote religion in and of itself through accommodations for symbols, vouchers, and things of that nature. Accommodationism actually constitutes a very originalist and textualist interpretation of the 1st Amendment as it historically reflects the Founders' intent in drafting the Bill of Rights. It makes sense, the point was to prevent the federal govt from establishing a state religion, that's really the core of it but doesn't preclude them from accommodating religious individuals and entities in promoting religion as a whole. It is what it is.

From the looks of it, the Lemon test is on its last legs.
