I agree with this. The NCAA cleared smart meaning he was not provided with impermissible benefits. So the phone conversation in itself is just speaking about an offer which is a violation but should be a slap on the wrist at most

Wade is not under investigation by the NCAA or the FBI either. Why the suspension in the first place? Because the administration chose to believe a media hack other than their own coach that they hired.

An interview with LSU and/or the NCAA could have gone;

NCAA Man: Hey Javonte Smart. Did you lobby for or receive impermissible benefits from LSU?

JS: No.

NCAA Man: Then what was Coach Wade talking about on the phone about an offer to Smart?

JS: I dunno. You'd have to ask him about that.

NCAA Man: Are you sure?

JS: Yeah. I dunno what coach was talking about at all on that phone call

NCAA Man: Y'know you really shouldn't lie to us.

JS: Alright. I still don't know what Coach Wade was talking bout tho.

The NCAA knows who it is going to get answers from and has no means of compelling Smart to incriminate himself. Wade incriminated himself by being a total fricking dumbass and talking to frickwad McBallface on the phone instead of letting a middle man do it. The NCAA has no reason to rush an investigation and is willing to wait for Wade to testify or not testify and go over the evidence at that time as opposed to then or now when more evidence could surface.

I'm aware of all of that.

LSU certainly took a pulse of the NCAA before they acted.

But none of that means that we know for a fact that Smart was cleared *by the NCAA*.

All we know for certain is that LSU did their investigation with the NCAA by their side and LSU decided to allow Smart to play.

LSU never said the NCAA gave their blessing. The NCAA made no statement. Don't assume the NCAA made any ruling whatsoever on Smart.
