I wouldn't call it victim shaming exactly. however I do not see how his alcohol use and pot habit is relevant in this case since they were made to drink a frick ton of alcohol. Dude still took things a bit too far.

It is relevant because there were 20+ other kids also being hazed that night and only one of them died.
The defense is trying to build a case around a story that if the hazing was so extreme, why weren't the other kids also near death? They will try to say that it wasn't the hazing that killed him but his own lack of limit control.
They will say that the hazing was the vehicle that killed him but that Gruver was driving that vehicle, not the Hazers.
I am not saying this defense is right or wrong or whether it will work but it's obvious that's what they are going for.

I'm not sure admitting it would make a difference in the jury's decision. The kid's BAC was .495, which is so high that I don't see how anyone can claim that they just assumed Gruver was drinking the same as he normally does. This will be an appealable issue though for the Defendants if they're convicted.
