Midland (TX) Police Officer killed by man who thought his home was being burglarized

This will be a very interesting case. They charged the homeowner with second-degree manslaughter.

They officers were not serving a warrant, but were called to the house by somebody. They allegedly loudly announced they were police but the homeowner still fired on them because he claims he thought his house was being broken into. The courts will go in circles on this one.

Either way, RIP Officer Heidelberg.

It’s very unfortunate but I’d have to ere on sidin with the homeowner on this one.

Amazing how quickly he was charged vs the dallas cop lady who entered the upstairs neighbor's apartment.

I'll be very surprised if there is any proof they "loudly" announced themselves.

If there is body came footage, and this officer gave more than one announcement, then sorry homeowner you need to be charged. Unless there is some extenuating circumstances like hes deaf or in a part of the house its impossible to hear, I feel the charge should be manslaughter at most. But even in this case, I'll withhold judgement until more facts are known.



Would having any "no trespassing signs" or "private property" make any difference in situations like these, if there is no warrant?

If I get woke up in my home in the middle of the night to flashlights and people shouting I'm not so sure that in a sleepy state I'd wait to figure out what they are saying.

If I'm invading a home and want to get the upper hand the first thing I'm doing is shouting "police" when I break down the front door.

Then you should hope there is never an emergency around your home while you sleep. No time for them to get a warrant if there is a fire, chemical spill, etc.

Do they have to time to get the fire department, who'd actually handle both of those issues? If so, stay the frick off my lawn cop

I'd feel bad except the cop in Dallas killed a guy in his own house and the boys in blue slow walked it and tried to justify it.

Yeah, this is where I'm at. Not sure how shouting you are the police really means anything today. I mean, if I just assume you are telling the truth, I could end up dead myself. Tough situation all around.

If they dont have a warrant and the homeowner didnt let them in I have a hard time believing they had legal authority to be there to begin with.
