From FOX News:

quote:

The Department of Justice Office of Legal Counsel issued an opinion Wednesday supporting President Trump's appointment of Matthew Whitaker as acting attorney general.

In the opening line of the opinion the OLC says Trump-appointed Whitaker under the Federal Vacancies Reform Act of 1998, and further reveals, "This Office previously had advised that the President could designate a senior Department of Justice Official, such as Mr. Whitaker, as Acting Attorney General..."

Suck on that Judge Nap.

He needs to be shown the one-way door. Jonathan Turley makes Nap look like a third grader when it comes to legal opinions.

I think Judge Nap must bet bigly against Trump, took it hard in the shorts, and now holds a grudge. He really adds zero value to FOX any longer and needs to go.

Now, Alan Dershowitz, who is upfront with his disdain for Trump, offers real professional, learned opinion that I respect.

Good Lawd...he has a legal opinion that DIFFERS from others. Why is that such a bad thing?

He can be wrong and intelligent, honest, and thoughtful at the same time.

I think our discourse has gone off the rails. We excoriate anyone that isn't lock-step with us. I think that is a bad thing.

Great legal mind that explains things to a 7th grade level (not meant as a negative). Whenever he's on, I'm listening.

it sounds like some deep state leftovers in the DOJ tried to cite a fast one but got called out. they can't touch this legally and the Brennan types can suck an egg.

BHP,

Get with the program.

Everything is either the best or the worst. There is no middle ground.

"how about getting with the program? Why don't you jump on the team and come on in for the big win?"

Consistently on the wrong side of things adds zero benefit.

If the QB is dyslexic and throws right when the play calls for left, and does it every time, you call that QB a bust. If the pitcher always throws high and inside when the lineup dictates he throws curves, he gets sent to the dugout. If a cop always pulls his gun during routine traffic stops, he gets fired. If a fireman STARTS fires he gets arrested.

Only weather forecasters get to be so wrong and keep their job. And a Judge? So much for innocent people going free. Damned good thing he's not on the bench any longer. Lawyers should be lining up to appeal his decisions.

Exactly. I don't think any reasonable-thinking person thought that Whitaker couldn't serve. So it really wasn't a surprise.

'Unquestionably' authorized to lead DOJ

quote:

The Justice Department Wednesday defended President Donald Trump's appointment of acting Attorney General Matthew Whitaker by asserting that his senior executive status at the department “unquestionably” authorized him to serve despite his lack of Senate confirmation.

The 20-page opinion issued by Justice’s Office of Legal Counsel based its findings on provisions of the Vacancies Reform Act, which allows for the appointment of a senior staffer who had been in office for at least 90 days. Prior to his appointment, Whitaker served as chief of staff to Attorney General Jeff Sessions, who was fired Nov. 7.

The announcement that we really need to wait for happens after Whitaker meets with the ethics lawyer. Then DOJ announces that Whitaker can oversee the Mueller probe.
