Help me settle a bet about herpes

There are a few beers riding on this. A coworker and I got into a discussion about herpes this morning. His girlfriend has it (along with HPV) but after a recent visit to the doctor, she has come back "clean" with no signs.
So he fricked her without a condom and also performed oral on her last night. He says he can't get the herp. I told him he has it now. We got into an argument that ended in a beer bet.
What do the docs of OT say?

Its not 100% he has it. But very likely.

This OT doc says there is a small chance he would have caught it, but if there wasn't a breakout on her or open cuts on himself then chances are he's clean.

i thought you could only get it if there was a visible outbreak. i've never had to deal with that though

If she's taking medication regularly I think the chances of him catching it are around 4%. However he's going to have regrets when the throat cancer hits him.

If he’s ever had chicken pox he already has it stored in his dorsal root ganglion. HOWEVER these are different types. She should only be contagious when she has an outbreak and is showing visible signs. Also, he will be more susceptible when he is expressing opportunistic avenues for the virus.
But seriously, he is ignorant of the virus, or just a big stupid dummy for even risking swimming in the known infected waters without protection.

"Clean with no signs" does not equal "herpes is cured".
