I think the problem is the trademark. If the City doesn’t contest the trademark, then these guys could file for incontestable status after 5 years. Once that happens they could leave the actual operation of the st roch market and own the rights to its name, so any future operators including the city would be infringing on the trademark.

Probably right on the trademark. They should both agree to not trademark it
